Do not you have a glare – reflective vest?

From the end of August, pedestrians walking down the street after dark are required to wear reflective clothing. And since there is a duty, there must also be punishment for breaking it. And while the intention of the legislator was prevention, not punishment, however, pedestrians for lack of glare can be punished even very severe, because it reaches 5 thousand zlotys. All by overseeing the police are not including this type of misdemeanor in the credential tariff.

 

The obligation to wear reflectors after dusk outside the built-up area was aroused by intense emotions at the stage of discussion of its legitimacy. MEPs who wanted to implement this solution wanted to improve road safety. They asserted that it was not about introducing new sanctions and penalties, but about education and instruction of pedestrians.

 

Legislators have pointed out, however, that if a duty is introduced, there must be a sanction. If a specific rule is not introduced, pedestrians will be punished according to general regulations, a mandate of up to PLN 500 or a fine imposed by a court of up to several thousand zlotys. The police announced the inclusion of this type of offense into the tariff. The obligation to wear reflective vest was therefore enacted and the 31st of August entered into force.

 

The TVP Info reporter asked the cop what punishment is currently being punished for not being responsible for wearing retro reflectors after dark.

– For the offense according to the tariff can be punished with a penalty of 20 to 500 gold, so it is definitely cheaper to buy such a reflection and always have it at hand – said Sergeant. TVP Info guest Tomasz Story from RMF FM disagreed with the policeman’s opinion and reported that such punishment in the tariff does not exist.

– In October last year the tariff was published and this offense is not here. It results from the fact that each of us for lack of reflect can be punished by a policeman’s mandate, in principle, arbitrarily, from 20 to 500 gold, or even referral to a court where he is punishable up to 3,000 zł fine – said Score.

 

However, it turns out that the punishment may be even higher.

– In the case of refusal to accept a mandate, the policeman prepares a petition to the district court. The district court is going to impose a fine that can be up to 5000 zlotys according to the law, said TVP Info Commissioner Robert, the traffic department of the Warsaw Metropolitan Police Department. The Commissioner emphasized that imposing fines at maximum for lack of glare is very unlikely. However, the mere fact that there is theoretically possible exists.

 

The possible penalty for the lack of a reflective element is significantly different from the others that fall into this category of offenses. The credential of the mandate includes different pedestrian traffic penalties, but none of them is higher than 100 zlotys.

 

A month to fix the mistake

The Ministry of Internal Affairs ordered the Police Headquarters to rectify the mistake and create a new tariff by 5 December. However, solving the problem of penal sanction for failure to reflect can take much longer, because the introduction of the tariff in force involves a procedure that takes months. Until then, the cop will decide how high the penalty will be for failure and failure to reflect when we go after dark outside the city.
