Why a reflective vest cannot be stored in the trunk of a car

Last spring, amendments to the traffic rules came into force, obliging drivers leaving a car for some reason on the road at night to wear a reflective vest. Obedient car owners of “luminous” clothes were bought and thrown her far away – in the cargo hold. But storing capes in the trunk is not the best idea.

 

Thus, paragraph 2.3.4 of the traffic regulations obliges the driver “in the case of a forced stop of a vehicle or an accident outside residential areas at night or in conditions of limited visibility while being on the roadway or curb to be dressed in a jacket, vest or vest with a retro-reflective tapes material complying with the requirements of GOST 12.4.281–2014″.

 

Drivers who leave a car without a vest after, for example, an accident, are fined as much as 1000 rubles in accordance with art. 12.27 Administrative Code. By the same steering that came out of the car in order to relieve themselves, to smoke a cigarette or for any other needs, traffic police are more loyal. Violation of art. 12.29 of the Code of Administrative Offenses entails an educational conversation or a material sanction facilitating a wallet of 500 rubles.

 

It is curious, but not in any regulatory action that the driver is obliged to carry the reflective vest always with him. In other words, with the standard verification of documents, the traffic cop does not have the right to require the driver to present a cape. However, this does not forbid him to be cunning: the traffic police officer may ask the helmsman to get out of the car, expressing a desire to inspect the car.

 

Yes, it is an inspection. We all know that inspection is a voluntary procedure, which involves only a visual inspection of the vehicle. Most of our colleagues are confused in legal terms, as in those same three pines. For those who do not know: the inspector can ask the driver to leave the car only during a search, which requires an iron base, two witnesses and, of course, a protocol.

 

But back to the topic. Suppose, to the delight of a traffic cop, he was caught deep in the night on the highway but did not know, “floating” in terms. The driver, obeying the requirement to get out of the car, carefully gets out of it. And well, if the driver at the last moment remembers about the reflective cape. It is doubly good if this very cloak is waiting in the wings in the car, and not in the trunk.

 

And if not, here is an explanation: walking from the driver’s door to the lid of the cargo compartment, the helmsman violates the same paragraph 2.3.4 of the traffic rules, which obliges him to wear the vest with reflective material. An extremely unpleasant situation is obtained – a fine of 500 rubles is written out literally out of the blue.

 

To avoid this, carry a reflective cape in the cabin. And in general, do not forget about it. And the point here is not so much in the sanctions, as in the elementary security.
